Legal language quickly adjusted on 11 county donation agreements

WARSAW — The Kosciusko County commissioners followed through on plans to amend all agreements involving donation funds.

The move came on Tuesday, a few weeks after county leaders realized that establishment of donation funds — including one for Flock cameras — should have included a vote by council on the matter.

At Tuesday’s county commissioners meeting, County Attorney Ed Ormsby proposed identical changes to 11 funds, including those for Camp Hero, DARE, JCAP, and one used to benefit Veterans.

The commissioners agreed with all the changes, which will ensure the county council will have a vote in approving individual donations.

As questions arose over flock funding, some council members said they were unaware of the camera fund.

Attorney Travis McConnell, who brought up the issue originally in the midst of the fight against Flock, said Tuesday that he appreciated the county’s quick action on the issue. 

After looking into the matter, Ormsby recommended the county revise the policy at the commissioners’ meeting two weeks ago.

County Commissioner Bob Conley thanked Ormsby for his due diligence. Ormsby thanked County Auditor Alyssa Schmucker for researching the issue and assembling the list.

The commissioners have since dissolved the Flock donation account and terminated its contract with Flock after council voted unanimously to defund the program that had grown to include 31 cameras across the county.

Marshall County Flock

Flock continues to be a point of contention in Marshall County, where the county Commissioners voted 2-1 on Tuesday to place bags over six Flock cameras that the county controls as county officials debate what to do with an existing Flock Safety contract.

WNDU reports that County Commissioner Jesse Bohannon, an opponent of Flock cameras, said additional research is needed to determine how much authority the board has over the cameras. It was unclear how quickly the bags would be placed over the devices. The move does not affect cameras in Bremen or Plymouth.
